Morristown, New Jersey, Child Custody Attorney
If you have children and are considering divorce, maintaining a healthy, nurturing relationship with your children during and after the divorce is probably the one thing that concerns you most.
What Does "Best Interest of the Child" Mean to You?
At Simeone & O'Sullivan, we understand how important this issue is to our clients and we work hard to help them secure child custody arrangements that preserve their parental rights while minimizing the overall impact of the divorce on their children's emotional and psychological well-being.
If you are in Morris County or northern New Jersey and have concerns regarding the issue of child custody, talk to us. We are here to help.
Shared Parenting
New Jersey's "Best Interest of the Child" standard for child custody cases starts with the presumption that shared parenting (an equal or nearly equal joint custody arrangement) is best. In practical application however, 50/50 custody arrangements are the exception rather than the rule.
High Conflict Child Custody
Although no one wants to put children through the ordeal of a court battle, sometimes there is no other way to resolve the issue. In these situations, the experience of your attorney can be very important.
Attorney Salvatore Simeone has been dedicated to practicing family law in New Jersey since 1994 and has represented numerous clients at jury and bench trials involving the issue of child custody. As a client, you can rely on his experience to handle your case with efficiency, sensitivity and compassion, while minimizing the impact on the children themselves.
Parental Alienation
In cases of parental alienation (situations where one spouse tries to "poison" the children against the other), there is currently no state-recognized cause of action allowing the aggrieved spouse to sue and obtain damages. However, one recent case involving a claim for intentional infliction of emotional distress did succeed and may lead to other changes in this area.
